Abstract:
This thesis explores the role of arbitration in international law as a mechanism for dispute resolution, with a focus on the legal frameworks governing corporate arbitration. A thorough understanding of arbitration's legal regime is crucial for companies seeking efficient resolution of disputes. Under OHADA law, arbitration in international commercial transactions serves as a vital tool for resolving cross-border disputes, offering a flexible and binding alternative to litigation in national courts. By examining international and OHADA legal frameworks, this study elucidates the rights and obligations of the parties involved in arbitration, providing clarity and predictability in international trade relations.
